The Residential Conveyancing Process
Lanyon Bowdler’s Conveyancing Solicitors in Shrewsbury specialise in residential transactions, which generally takes place in the following three stages:
Once an offer on a property is accepted and a sale agreed, a series of checks will be carried out including confirming the identities and addresses of the buyers and sellers and making sure the required funds for purchasing the property are available.
Essential information about the property will be obtained and the survey and searches carried out. The contracts will be then prepared and thoroughly checked ahead of exchange with the other party.
Once prepared, the contracts will need to be signed before they can be exchanged. This will be coordinated by the legal teams on both sides and it is only once the exchange takes place that the agreed sale becomes legally binding.
Completion generally takes place two weeks after the exchange of contracts to allow time for all the paperwork to be finalised and for the funds to be put in place. Once payments for the property and any outstanding fees have been made the sale is complete and the new owner will be registered with the Land Registry.
The legal work we carry out for you will depend on whether you are buying or selling a property.
If you are purchasing a property we will:
- establish your identity and address
- confirm your available funds
- advise on the most suitable survey
- check all property information provided by the seller
- carry out local authority searches
- check that all the required planning permissions and building regulations are in place
- effectively manage any issues resulting from the survey, local authority searches and property information
- renegotiate price where appropriate, to protect your personal and financial interests.
- thoroughly prepare, draft and check your contract
- arrange for you to sign your contract
- coordinate the exchange of contracts
- complete final paperwork
- manage the financial aspects
- register you as the owner of the property with the Land Registry and remove any reference to the previous owner and mortgage
If you are selling a property we will:
- verify your ID and address
- obtain the title deed for the property
- coordinate all the property information
- effectively manage any issues that may arise from the survey or searches and renegotiate where appropriate
- prepare and check your contract
- arrange for you to sign the contract
- coordinate the exchange of contracts
- complete all paperwork
- obtain mortgage statements
- manage financial transactions including the payment of your outstanding mortgage and any other fees
